|
These terms will govern any orders placed with rubberbracelets.com and its affiliates; therefore we encourage you to read these terms prior to placing your order. By submitting an order to rubberbracelets.com, you (also referred to below as the customer) are hereby agreeing to all the terms and conditions as set forth below. This agreement is in lieu of a written consent, and will be binding by the both the customer and/or their representative(s).

rubberbracelets.com specializes in custom silicone wristbands. rubberbracelets.com strives to deliver the highest quality as well as exceptional service at the lowest prices in the market. While we are committed to meet your every need and expectation, we wish to inform you of certain limitations that are inherent within the custom silicone wristband industry.

Payment is due in full prior to commencement of production. Credit card authorization and address verification must be received prior to processing the order form. We accept payments in the form of Visa, MasterCard, American Express, Discover, Goggle checkout and Pay Pal only.
We accept Money Orders or checks for payment on official U.S. PO or school PO. rubberbracelets will not ship any order prior to payment. We will not accept any other forms of payment other than listed above. Any mailed orders with checks or money orders should include the PO number and rubberbracelets.com order number. All other checks or money orders not associated with a PO will not be fulfilled or returned.
* No faxed/emailed PO’s will be referred to by the customers PO number. We will only refer to our order number.
We do not ship orders COD; we do not offer credit terms or Net 30 credit accounts. We are not responsible for delays in order processing due to declined credit cards, waiting for PayPal checks to clear, or delays in PO faxes. PayPal orders will begin production once payment clears PayPal. Purchase orders will begin processing once the official purchase order is received (via fax, email, or mail) and verified. In the event payment is not received within thirty (30) days on a purchase order shipment, rubberbracelets.com shall charge interest on the outstanding balance of 18% per annum or the maximum amount allowed by law, whichever is greater. rubberbracelets.com shall also be entitled to commence collection proceedings on any amount outstanding after thirty days and purchaser, by accepting the goods purchased consents to personal jurisdiction to the Federal District and State District Courts of the State of Texas.
Any declined checks will be given an added fee of 18% of the order amount for the reason that the order has an outstanding balance.
We reserve the right to refuse service to anyone at any time for any reason. We also reserve the right to not produce phrases on silicone wristbands that we determine to be offensive, vulgar, violent, or in any way disagree with our policies, procedures, morals, and ethics.
Texas residents will be charged Sales Tax in the amount of 8.25%.
Due to the expedited nature of our product once your order is placed and payment verified it enters the production cycle the next business day. For this reason orders can not be changed once they are placed. Please verify all information before you approve your order.

You will receive an order confirmation/Sales invoice via email shortly after an order is placed over the phone. This is an automated email system.
The email address given on the order should be the person responsible for approval of the order. We are not responsible for an order approved by some one other than the decision maker.
Please go over the form very carefully to ensure that all the information is accurate. For any corrections or concerns, simply call back within 12 hours so that we may promptly correct any information prior to processing the order.
By approval, the customer agrees to the order that all the information is correct and accurate. Upon the customer's approval, the order will be processed immediately "as is" and cannot be modified.
If the automated email is not approved before or after payment we reserve the right to delay production until an approval is made on any order we consider high risk.
If an order/invoice is not approved and is received with error we are not liable or inclined to redo, refund or discount for the mistake.
Online orders do not receive a confirmation email. The reason is, the customer is responsible for the information that is/was inputted at the point of sale.
All online orders stay in an automated system with little or no human interactions, therefore any mistakes will not be seen or corrected.
A customer can request an email of the order at any time.
All orders go into production the following business day of the payment transaction.

Proofing will add several days to your production timeline, therefore you will only receive an emailed "proof" upon request. If the proof has not received an approval by the customer the order will remain in "pending" status. This proof enables you to view the wristbands, but it will not depict exact band colors nor will it illustrate the exact engrave (debossed) size, as it is merely a computer-generated image.A proof will not guarantee an exact final match.
The proof must be approved before production begins. When a proof is approved it goes immediately into production therefore no changes can be made to the proof after approval.
Although every effort will be made to prevent errors, (grammar, spelling and layout) we will not be responsible for any errors on an order that was proofed and approved by the customer or customer's representative. These errors will be corrected at the customer's sole expense.
* If an order has a specific "in hands" date, a proof may delay production, thus jeopardizing your chances of receiving the order in a timely manner. We will not be held responsible for any resulting delays on these orders.
Proofs are not intended to be "decision making tools" for the customer. There will be no option to cancel an order simply because the proof is not working out. The longer you take to approve a proof – either because of changes that you request, or otherwise – the longer the delay in the production of your order. Therefore please do not place an order merely in order to obtain a proof, as the order will be binding, regardless of whether the proof is approved or not.
In the event an order is printed with an incorrectly submitted artwork/logo, rubberbracelets.com will not be held responsible for your oversight, and payment in full will be valid for the completed work. You may request a redo; however it will be at your expense.

Check your spam or deleted folders to ensure that these important emails are not blocked due to firewalls or spam filters on your computer.
The proof must be approved before production begins. When a proof is approved it goes immediately into production therefore no changes can be made to the proof after approval.
* We will not be held responsible for failure of any email communication to you either due to incorrectly spelled email addresses, non-working email address or spam filters that prohibit our emails from reaching you.

When placing an online order, if you press 'SUBMIT' more than once, your card may be charged again. Once you inform us of any such duplicate charges, we will promptly credit the amount back to you, however, we will not accept any responsibility for any subsequent bank fees that may be imposed upon you due to these duplicate charges.
Declined credit cards of any type will remain in pending status until the issue is fixed.
We will attempt to contact our customers via email and phone calls but if we receive no reply the order will stay in pending. We are not at fault for any late orders due to credit card issues of any kind.
By placing an order online the customer is giving rubberbracelets the permission to charge the credit card they provide. When a phone order is approved via the automated email system the customer also gives rubberbracelets the permission to charge the credit card. By agreeing to this policy the customer can not charge back the amount of the order to avoid payment.
All orders go into production the following business day of the payment transaction.

For any corrections or changes that may be necessary on a "normal turnaround" order, please call the sales department. All phone order changes must be made in writing within 12 hours upon receipt of the emailed confirmation. Failure to do so may result in incorrectly printed orders or delays in shipping. Any request of change for online orders after 12 hours of placing the order will be noted but not guaranteed.
Once the order has left the sales department, we will be unable to change the order.
On any online order that a change was made with error we are not responsible. Therefore note that we will not be held responsible for any changes requested after the 12hr period.
Note: NO CHANGES whatsoever will be accepted on 24HR or 3-Day Rush Orders.

rubberbracelets.com begins production on incoming orders almost immediately. Our production line works 7 days a week in order to meet customers’ timelines. Therefore, we will not accept any order cancellation requests. As you know, a custom printed order may not be resold or restocked at our end; therefore rubberbracelets.com will only issue a store credit for orders that require cancellation. This in-store credit will not expire, and may be used towards any item (both blank and custom printed wristbands) in our inventory.

A repeat order (or "re-order") may not bear the exact colors as in the "original" order. This is due to several factors relevant to the mixing of silicone colors. Therefore, we strongly recommend that you send us a PMS color from the original order PRIOR to placing the re-order, so that we may ensure a color match. The engraved size of a re-order may also not match the engraved size of the original order.
Prices may change between redo.

Please send your custom instructions to us immediately. If you are emailing it to the art department, please put the name and order number on the subject line. We will not accept any responsibility for delays in processing an order if we do not receive the artwork in a timely manner.
rubberbracelets.com makes several attempts to contact the customer in the event no artwork/logo, therefore we will not be responsible for the timeline of an order if we do not receive the artwork/logo.
* Customers will assume complete responsibility to obtain permission for reproduction of logos, patents, trademarks and copyrights. By agreeing to print any submitted artwork, rubberbracelets.com will not be held liable under any circumstances.

We will not be responsible for any missing information on your order form nor for any missing custom instructions.
In order to correctly follow your custom instructions, we require that all information relating to your 'artwork' or 'logo' be sent TOGETHER as 'one' email. Therefore, if you send your logo in one email, and the text to be 'included' with the logo in another email, we will NOT be responsible for putting the two together. Do not send us multiple logos or artwork and assume we will know which one to use. We will not be responsible in the event we pick the 'incorrect' logo.

Imprint colors must be carefully chosen. We recommend that you choose light color inks to be printed or injected onto dark color bands, as this provides more contrast than a dark colored imprint on a dark colored silicone rubber bracelets or a light colored imprint on a light colored bands.
For example, if you order brown imprint color on brown wristbands, the imprint would not show up well against the brown background. However, many customers have their own pre-conceived notions about what looks good and what does not, therefore, we will NOT judge your options NOR will we be responsible for the choice of imprint color(s) that you make.
* Please Note * Printed wristbands are used best as promotional products. In time they do fade. For a longer lasting message we recommend ink injected wristbands.

|
A 2 layer band has a color on the inside of the band and a second color that is printed on the outside of the band. When we mold your message onto the band the bottom color of the band shows through and displays your message more vibrantly.
* Please Note * The 2 Layer bands are in most cases used as a promotional item, as they do fade. In some cases the bands will start fade in less than 2 weeks.
We do recommend "Ink Injected bands" for bands being used as memorial items, or needed for long term use as they have a longer lifespan.

Tyvek, Plastic and Vinyl wristbands are made to be used for one time events. Once the wristband is attached it can not be unattached and re-used.
Tyvek wristbands are water resistant but colors made fade.
Plastic and Vinyl is water proof but logo might fade over time with extensive use.

In orders that product information is missing we try to contact the customer for verification. In cases we receive no reply after 24 hours we will proceed with our default options. For font type default is Arial Bold, font color will be Black, multi color bands will be Segmented and band size will be Adult.

|
All font sizes vary. We use Arial as a default because it is proven to be the easiest to read on a Debossed band. We will use any font on file or provided to us.
NOTE: Some font sizes will be smaller than others, we are not responsible for the final out come of a small font.

|
We can not provide a custom sample at no charge. If a pre-production sample is needed it will be treated as an order. There is not an option to have a sample of ink injected, printed or embossed, these have a minimum order of 100 bands. We do have a sample package that is free but the customer must pay for the shipping cost.
* Note that the inclusion of a pre-production sample will add to the turnaround time.

Silicone rubber bracelets are stocked in a wide variety of colors. Exact PMS color matches are not available. We try to match your color selections as closely as possible using PMS numbers as a reference only. Due to the nature of silicone colors, an exact match cannot be guaranteed.

|
You have a choice of turnaround timelines in most cases. Your choice should reflect your "in hands" date, and we will do our utmost to stay within the given time frame. Please note that we are not responsible for late receipt of any order due to any unforeseeable circumstances, for example a lengthier proofing time, an out-of-stock product, printing, weather-related issues or delays on behalf of the shipping company.
All orders go into production the following business day of the payment transaction.

The "estimated’ normal production time is 7-10 business days after receipt of order. This timeline is also dependant upon the size of the order and/or the complexity of the artwork or process employed. If you have a specific "in-hands" date, please ensure that there is adequate time before you opt for a "normal production" timeline.
When you request a pre-production sample or a digital proof, the production time will only begin upon approval of the sample or proof. Therefore the timeline may be delayed several days past the original estimate. All production timelines reflect business days.
* Production time does not include any shipping time; therefore shipping time must also be added to production time in order to get an accurate delivery time frame.

Rush orders should only be placed as a last resort. Custom engraving or printing entails intricate and detailed work, both on the part of the artist as well as the printer, therefore we recommend rush orders only as a last resort. No proofs are created for any rush orders, therefore the risk of error is higher with a rush order.

Note that delivery dates are only "estimated" and not "guaranteed" for orders with normal production timelines.
If you opt for "expedited" shipping method for your "normal production" order, only the method of shipping will be guaranteed, however the production timeline is still only "estimated". Therefore the order may still not reach you in the timeline required.

|
Production time is guaranteed on rush orders; however the delivery dates are only "estimated" unless you opt for expedited shipping.
When you place a rush order but then opt for "normal" or "ground" shipping method, please be advised that the delivery date will only be "estimated" and not guaranteed, as shipping companies do not offer guarantees for ground shipping.
However, if you opt for "expedited" shipping, the delivery date will be guaranteed, so the order will reach you in the timeline required.
Overnight or 3 day shipping is business days only.

All orders with the "made in China" option does not always mean the order is place only in China. We have the ability to produce both in China and the US. This option will allow us to use ether option to produce the order. The only way to guarantee the order to be place only in the US is to select the option.
If we fail to meet a promised delivery date on a 24hr rush order with expedited shipping, but you will still accept the order, then credit will be promptly issued for the difference between the 24hr (per piece) price and the 3-day rush (per piece) price.
If we fail to meet a promised delivery date on a 3-day rush order with expedited shipping, but you will still accept the order, then credit will be promptly issued for the difference between the 3-day rush (per piece) price and the normal production (per piece) price.
Normal production orders with estimated delivery dates are not guaranteed.
* Please note that once you submit your order, any changes, delayed artwork submissions, or delayed proof approvals will void our guarantee policy.

If the order is being shipped via FedEx, USPS, then once the order is ready to ship out; you will receive an automated email with a "tracking number" from the carrier of choice.
Please note that opting for Overnight or Second Day Air does not mean that you will receive your order the next day. Delivery time is based on the time it takes to produce your item PLUS the shipping time.
rubberbracelets.com will not be held responsible either in the event the customer is not available for delivery or the customer refuses delivery. If a substantially large order requires inside delivery or a residential delivery please specify that information when placing the order. You must have a physical address as FedEx; UPS doesn't ship to P.O. boxes.
To ensure proper delivery, we do require a signature. FedEx usually leaves a door tag notifying you of the delivery attempt if no one is available to sign. Simply follow the instructions on the door tag, and FedEx will leave the package at your door at the next delivery attempt. After three delivery attempts, FedEx will return your order torubberbracelets.com. If you would rather have the package left without having to sign for it, you can go into your local FedEx office at any time and sign a FedEx release waiver.
For International orders, we offer FedEx International Priority which gets the order to our international customers in about 15 days from the time the order is placed.
Important notice for our International Customers – Including Canada For orders shipping outside the U.S. - INCLUDING CANADA – local duties and/or taxes may be assessed upon delivery. These fees are not charged by rubberbracelets.com during checkout; therefore please consult your local customs office to determine these charges. We are not responsible for these duties and/or taxes.
Note that delivery dates outside of the U.S. are essentially "estimates", and in no event will rubberbracelets.com be liable for any consequential damages arising from delays in delivery.
All international shipping orders that did not pay for the international shipping will go into production and will be held in shipping until the charges are met.
All international order will communicate via email unless the customer calls our call center. The reason for this is our call center can not make out going international calls.
All international shipping is based on a flat fee.

Note that the products we carry are intended purely as promotional items; therefore products that may have minor visual imperfections should not be considered as defective or flawed items. In the event a 'product' defect is identified, we will replace the order in its entirety only upon endorsement of the defect by the manufacturer of the product. Likewise, if an imprint defect is identified, we will replace that portion of the order only upon confirmation of the defect.
Due to the nature of the production process, slight variations and imperfections in silicone bands wares are not considered flaws.
Variations in raw materials, molds, production equipment and melting temperatures may also result in variations of size, shape, engraving, font, color, pock marks, etc. These conditions are within acceptable industry standards.
From time to time, some products may differ in color, size, ink fill, printed as these are hand-made products that come from factories in China. Due to fluctuating manufacturer costs, prices may change without notice.
All website images are animated and made to resemble the product. Variations between image and product will happen.

Please check your order immediately upon receipt. All claims must be reported within 7 calendar days upon receipt of goods.
* Claims must be submitted IN WRITING. (Example: wrong color, incorrect imprint, incorrect size, incorrect fonts items etc)
* Attach digital image(s) to your email depicting the problem at hand.
* If unable to provide a photograph, you may ship us an "in-hands" sample of the product instead. (The address is under "Contact Us".)
* Upon receipt of the "visual", we promptly remedy the situation and redo the affected portion of the order if mandated.
* If the quantity to be replaced is LESS than 10% of the entire order, we reserve the right to process a credit for that amount rather than redoing that portion.
* All redo’s will ship via USPS or FedEX Ground. If you require expedited shipping, you will be responsible for those charges.
* Redo orders given because of shipments being lost in shipping by FedEx, UPS, DHL or USPS will be done after confirmation of the order being lost. The order will be redone in the same manner the order was originally placed.
* All orders of any size fall under our over/under policy. The policy is: No redo or remake will be given for missing or defective bands if the amount in question is less than 10% of the order.

As you may be aware, custom made products cannot be restocked. In fact, the industry standard for customized products dictates a no return and a no refund policy if the product has been received according to the order.
Expedited production and shipping cost will not be refund if the order arrives on time. In an isolated case if a refund is given, 25% of the total cost will be withheld.

If an order is not well received – either due to a typo or other issues – our policy to redo the order and ship it via ground shipping method will still prevail.
When an error has been confirmed, (upon following instructions under "claims") we will make every attempt to promptly redo the order. We will process the redo order exactly as you had originally requested minus any errors that we made. We will not change the product, the logo or artwork or the imprint color when processing the redo.

When a redo is no longer practical or even feasible, (either due to event date timelines, out-of-stock or quantity issues) rubberbracelets.com will issue a store credit for up to the same value as the original order minus any shipping fees.
Shipping charges will not be credited back as this charge is made on behalf of the shipping company. The store credit may be treated as cash, and may be used at any time and on any product we stock.

In all circumstances, rubberbracelets.com maximum liability is limited to the purchase price of the products sold. rubberbracelets.com will not, under any circumstance, be held liable for any claim or action that exceeds this liability limit. rubberbracelets.com will not be liable for any third party claims for damages against the customer, nor for malfunction of product, cause of delays, interruption of service, or loss of business. Due to fluctuating manufacturer costs, prices may change without notice.
